Abstract
It is a lawyer's duty to know the truth, even when it compromises his client. However, in criminal matters specifically, the client is presumed innocent. It is therefore not up to the lawyer to ‘betray’ the client by revealing an embarrassing truth to the judge. Such behaviour may also expose the lawyer to criminal and/or disciplinary proceedings for disclosure of professional secrecy. All this may seem paradoxical to the uninitiated, since the lawyer, although aware of an embarrassing truth, cannot reveal it to the detriment of his client.
