Droit pénal congolais de l’environnement : quel texte codificateur ?
Résumé
Consacré à la question de la codification du droit pénal de l’environnement congolais, le présent article propose, en inscrivant la réflexion dans une perspective de reconstruction du droit pénal de l’environnement, la codification des incriminations environnementales au sein d’un Code pénal de l’environnement. En effet, à rebours du Comité technique pour la réforme du Code pénal congolais, il démontre qu’en envisageant le Code comme un lieu d’émergence des valeurs fondamentales de la société, la protection de l’environnement trouvera meilleur refuge dans un Code pénal entièrement dédié à la protection des écosystèmes que dans le Code pénal ordinaire ou un Code de l’environnement.
Abstract
Devoted to the question of codifying Congolese environmental criminal law, this article proposes the codification of environmental incriminations within an Environmental Criminal Code, placing the reflection within a perspective of reconstruction of environmental criminal law. Contrary to the view of the Technical Committee for the Reform of the Congolese Penal Code, this paper shows that by viewing the Code as a place where society's fundamental values emerge, environmental protection would find a better home in a Penal Code dedicated entirely to the protection of ecosystems than in the ordinary Penal Code or an Environmental Code.
